Terms of Real Estate Sale:
Winning bidder/purchaser will pay $10,000 for each parcel - irrevocable Earnest Monies to be paid at close of Auction
August 18, 2011 and sign a real estate sales contract.
10% Buyers Premium. To be paid at closing or before to Potato State Auction Group, Inc.
Closing in 30 Days. On or before September 18, 2011 or make other arrangements.
Special Conditions of Sale:
- Seller presently has title to this property. At the time of closing, Seller agrees to convey good and marketable title to said property by a Warranty Deed subject only to (1) zoning ordinances affecting the property (2) general utility, sewer and drainage easements of record; (3) subdivision easements of record; (4) all oil, gas or mineral rights; (5) rights and restrictions pertaining to any cemeteries; and (6) leases, covenants, easements, restrictions and encumbrances specified herein.
- Auctioneer/Broker and Sellers do not warrant or covenant with Buyer with respect to the existence or nonexistence of any pollutants, contaminants or hazardous waste prohibited by federal, state or local law. The Buyer is to rely upon its own environment audit of the premises.
- A detailed title search for this property has not been made. Consequently, Auctioneer/Broker and Seller are not positive as to the status of the oil, gas and mineral rights. The Seller agrees to convey all its interest in any oil, gas, or mineral rights to the Purchaser at closing. Any oil, gas or mineral rights previously sold will not be conveyed to the Purchaser.
Possession:
Possession of the real estate will be granted to the Purchaser at closing.
Representation:
Purchaser and Seller acknowledge and agree that the only Auctioneer/Brokers involved in this transaction is Potato State Auction Group, Inc. and has acted as agent for the Seller in this transaction. Potato State Auction Group, Inc. has not acted as agent in this transaction for the Purchaser. Auctioneer/Brokers reserves the right to offer the property in any shape, form or fashion that is legal and ethical in order to produce the best offer to the Seller.

This contract will be closed by Northern Title Company, 20 North Main Street, Malad, Idaho 83252.
Northern Title Company will charge the purchaser(s) (unknown dollars) per transaction to close the sale. Northern Title Company will charge the purchaser(s) (unknown dollars) to close the property in it’s entirety. This fee includes conducting the closing, collecting and disbursing funds at closing and preparing a closing statement. If the purchaser wants other services than cash closing, those services will be available for an additional fee. The seller will pay for the preparation of a Warranty Deed and the Title Insurance.
